Terms and Conditions

ESSENTIAL INFORMATION

Enrolment Conditions:
By enrolling with TLK Community College (‘the College’), you agree that:

  • You must enrol and pay the applicable course fee before commencement
  • You must be aged 15 years and over, unless the course indicates it is for younger students or you have permission from the College to enrol
  • If enrolling in nationtally recognised training, you have read and understood the relevant Course Pre-Enrolment Information and Student Handbook
  • You meet any pre-requisites if applicable
  • You must abide by all College policies and procedures, and where relevant, adhere to the entitlement and eligibility criteria of Smart and Skilled
  • Confirmation of your enrolment may be subject to suitability assessment
  • You cannot bring any person who is not enrolled in the course with you, unless that person is your carer and you have pre-arranged their attendance with the College
  • The College reserves the right to alter any published arrangements, either before or during a course, or to cancel or terminate a course and to refuse any enrolment as permitted by law.

Fees and Charges
Fees are payable in advance and enrolments are not confirmed until fees have been paid. All texts, resources and materials are included in the cost of the course unless otherwise stated in our advertising material. All prices include GST where applicable. Part payments are only accepted for courses over $1,000. Receipts are provided with confirmation and any reissue of a receipt incurs a $25.00 administration charge.

Fee Assurance
The College is required to protect fees paid in advance for nationally recognised training. To meet this regulation, the College may accept payment of no more than $1,000 from individuals prior to the commencement of their course. Following course commencement, the College may require payment of additional fees in advance from the student but only such that at any given time, the total amount required to be paid which is attributable to tuition or other services yet to be delivered to the student does not exceed $1,500.

Concessions
Concessions of $10 are available to participants who are in receipt of an eligible benefit and who produce a current benefit card e.g. Aged Pension, Disability Support Pension, Sole Parent Payment, Carer Payment, Newstart Allowance, Sickness Benefit Allowance, Family Supplement Benefit, Seniors Card holders and DVA’s. Concessions are available to eligible Austudy students.

Purchase Orders
Businesses who wish to pay for course fees on behalf of a student may forward a purchase order, accompanied by a completed enrolment form. An invoice will then be issued.

Fee Assistance
Eligibility requirements for student assistance external to the College (e.g. Austudy, Youth Allowance, and Abstudy) may vary across agencies (e.g. Centrelink and Veterans' Affairs). Prior to enrolment it is your responsibility to discuss your study options and requirements with the relevant agency.

Completion Guarantee
The College is committed to making every reasonable effort to ensure that if a student enrols with us they can complete the study program. The College will only commence a course when there are sufficient students enrolled to do so. Should the course need to be cancelled due to limited enrolments, the College will reimburse all students the fees already paid to the College. Once the course has started, the College guarantees to complete the course within the period advertised. Should circumstances arise beyond our control which affects our ability to continue a course, such as a trainer becoming ill or resigning unexpectedly and we are unable to source a suitable replacement immediately, or when continuing student numbers fall too low, in those circumstances the College guarantees that it will: refund any fees paid for modules or units we have not delivered; issue Statements of Attainment for all the work successfully completed; and, assist the student to locate to an equivalent course with another Registered Training Organisation.

Refund Conditions
Please choose your course carefully. Only in the event of a cancellation of a course can a refund be made. The College regrets it cannot accept responsibility for changes in student work commitments or personal circumstances. Refunds will not be granted to students who are unable to attend courses due to changes in personal circumstances, work commitments or other reasons beyond our control.

Transfer Requests
Transfer requests received five (5) working days before the commencement of a course will be considered and accommodated where possible. A $25 administration charge will apply for each transfer. Requests for transfers after this time will be declined, except in the case of serious, verifiable illness. Notification must be received in writing (or email) within five (5) working days. Once approved, a transfer is valid only for the subsequent term. Any course fee differences when transferring will attract either a credit towards other training (but no refund) or a required payment of the difference, whichever applies. Once you have chosen to transfer, no refunds will be offered if you then chose to withdraw. Refunds will only apply if you transfer from a cancelled class.

Cancellations
The College reserves the right to cancel, shorten or vary courses. Courses with low enrolments may be cancelled. You will be offered a full refund or a transfer to another course of your choice. Some courses may be permitted to continue at the same fee, but for a shorter period at our discretion. We leave the decision to cancel to within 24 hours of the course commencement to maximise the chances that the minimum number of students will be reached. In the event of course cancellation, we will make every effort to contact you. When enrolling, please provide your phone, fax and email contacts accurately.

Disability
If you have a disability and need support to participate in learning you should discuss individual needs with the Coordinator before completing your enrolment.

Certificates – Accredited Training
If you successfully complete the requirements of an accredited course, you will receive a Statement of Attainment or Certificate (depending on the course). Certificates are included in the course fee. If a student requests a document replacement where the College has already provided the document, then a $55-00 replacement fee is applicable for each Statement of Attainment or Qualification (including Transcript). To obtain a replacement, the student should complete an Application for Re-Issue of Certificate Form.

Certificates of Participation (Non-Accredited Training)
A Statement of Participation is available for students seeking a record for non-accredited course attendance. The fee is $15-00 per individual certificate (unless it is otherwise stated as included with the course or workshop). Students must have attended at least 80% of the course / workshop to be eligible and requests must be made within 12 months of course completion. Please select and pay for this at the time of enrolment (via the tick box on the enrolment form), or otherwise please complete an Application for Certificate of Participation Form.

National Recognition and Credit Transfer (CT)
The College recognises the qualifications issued by other registered training organisations based in any State or Territory of Australia.

Recognition of Prior Learning (RPL)
All students in accredited courses may seek to have prior learning recognised through a formal process that adheres to the requirements of the accrediting authorities.

Evaluation
At some stage during the course you will be asked to complete an evaluation form. Your feedback is important to us. Evaluation forms may be handed to the tutor or sent in by mail. If you are not happy with the course please do not hesitate to contact the office so we can address it without delay.

Pricing Information
Although the College makes every effort to ensure the prices listed are correct, mistakes may sometimes be made. If a mistake is discovered, the College reserves the right to make changes without prior notice.

Privacy Notice:
Under the (Commonwealth) Data Provision Requirements 2012, TLK Community College (the ‘College’) is required to collect personal information about you and to disclose that personal information to the National Centre for Vocational Education Research Ltd (NCVER).

Your personal information (including the personal information contained on this enrolment form) may be used or disclosed by the College for statistical, administrative, regulatory and research purposes. The College may disclose your personal information for these purposes to:

  • Commonwealth and State or Territory government departments and authorised agencies and
  • NCVER.

Personal information that has been disclosed to NCVER may be used or disclosed by NCVER for the following purposes:

  • Populating authenticated Vocational Education and Training (VET) transcripts
  • Facilitating statistics and research relating to education, including surveys and data linkage
  • Pre-populating RTO student enrolment forms
  • Understanding how the VET market operates, for policy, workforce planning and consumer information and
  • Administering VET, including program administration, regulation, monitoring and evaluation.

You may receive a student survey which may be administered by a government department or NCVER employee, agent or third party contractor or other authorised agencies. Please note you may opt out of the survey at the time of being contacted.

NCVER will collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988 (Cth), the National VET Data Policy and all NCVER policies and protocols (including those published on NCVER’s website at www.ncver.edu.au).

The College may also disclose your personal information to:

  • A school if you are a secondary student undertaking VET, including a school-based apprenticeship or traineeship
  • An employer if you are enrolled in training paid by your employer
  • Authorised entities conducting student surveys or research.

For training subsidised by the NSW Government, including Smart and Skilled, personal information collected by the College may be disclosed to a NSW Government Department. The Department may disclose personal information to other Australian government agencies, including those located in States and Territories outside New South Wales.

Government agencies may use your personal information for any purpose relating to the exercise of their government functions, including but not limited to determining your eligibility to receive subsidised training or for any fee exemptions or concessions. Your personal information may also be disclosed to other third parties if required by law.

This notice is provided in addition to the College’s Privacy Policy, available on-line at www.tlkcc.com.au or from College reception.

Declaration and Consent:
By lodging and enrolment application you declare that the information provided in your application is to the best of your knowledge true, correct and not misleading in any way. You consent to the collection, use and disclosure of your personal information in accordance with the College’s Privacy Notice. You acknowledge and agree that a government department or authorised agent may contact you by telephone, email or post during or after you have ceased any subsidised training with the College for the purpose of evaluating and assessing your training.

General Information
The College reserves the right to alter this information without warning. The College accepts no responsibility for student vehicles or personal property. The College reserves the right of entry within the parameters of its Access and Equity policy, which is available on request. Enrolment is conditional on the student’s adherence to College rules and regulations. The College reserves the right to remove students who are not of good behaviour from the class. The ACE Practitioner (teacher/ tutor) is deemed the person in charge of the class.
